OK, the 2-1 5th CA decision covers only TX, LA, and MS, so not only immigrants living in those three states, but all who are sent on the transports to concentration camps are also *presumably* deprived of the right to post bond and challenge on habeas grounds. But, if the immigrants who were snatched out of jurisdictions that still recognize right to post bond, can't their legal reps still file, and have courts order their clients returned to resume processes to gain hearings? Wasn't that the case for Liam Ramos and his father?
Confusion reigns, which, of course, is the objective, as Stephen Miller maniacally presses for his frenzied demands for "3000/day" arrests.
they are not deporting just illegal immigrants, they are deporting people legally in the immigration system. in other words, deprting people for following the laws!
Kudos for the link to Sir Ian McKellen's speech, The Stranger's Case, from the play Thomas More, which Shakespeare himself contributed to, including the speech. It's a remarkable speech on its own, and at the same time sadly far too appropriate today. And of course, Sir Ian's presentation of it was deep, powerful, and masterfully portrayed.
I sent a link to it to an Australian friend, who in turn forwarded it to several of his associates in Sydney's Bell Shakespeare Company (he and his wife are sponsor/producers). They, in turn, were most thankful - one said that the speech gave her goosebumps, and she deals with Shakespeare every day.
Not defend the 5th circuit but maaayybe a factor with SCOTUS that is reported approximately never is at play with the ruling discussed at the top of the post. That is, SCOTUS, and the 5th circuit here, has no enforcement mechanism. It relies on rulings being obeyed. Get a lawless thug like Trump involved and get him ignoring orders en masses as David notes and there’s a problem, a big one, actual decisions notwithstanding. (Historically, that problem is why Brown v Bd of Ed got a near immediate follow up—Southern states, practically speaking, told SCOTUS to f*** itself.)
