But a much scarier idea is in BREYER'S Footnote, footnote 12: For instance, the Ninth Circuit’s test would likely enable a President to use federal law enforcement agents to stoke tensions and then use any resistance as justification to call forth the National Guard.
Basically ICE does something egregious and if people object by doing "violent" things like standing in front of a van--not hitting it, just standing there like Tiananmen Square--then bingo, National Guard incoming.
