I looked at the statutes that the new OLC memorandum covers. (section 404 of the original statute). It is difficult to see why reporting of undocumented aliens known to any State agency governs eligibility for the programs covered. Only one of the statutes asks specifically about citizenship at all; that is the first one, about Temporary Assistance. It is one question from a HUGE list of things "the state" needs to report about families under the program; only the agency administering the program would be in a position to find this out.
The original OLC is much better reasoned--it basically says that the agency DEALING with the program is the one who has to report its knowledge because it is the one that HAS the knowledge. Once again, litigation incoming.

Since the administration keeps violating court orders and has been found in contempt of court why hasn’t anyone gone to jail?
