Firstly, given reality, any contempt proceeding is something of a dubious thing. So they’re doing DCCA dragging their feet as David reported, is IMO a huge so what.

As for the Roberts junta and DOE, maybe it’s me but reporting on anything like that maybe should note that the odds of the Democrats, if restored to power, doing anything about it — in this case, restoring it — is near zilch. (That’s presuming that the odds of that Democratic Party is a progressive one and not the alt-Republican failure we have now.)

Maybe it’s age; you just see too much bullshit repeat too many times…

I would hope the Democrats riding into power would restore the DOE to full staffing buts it's going to be a heavy lift since the Republicans as they always do, will clean out the pantries and empty out the coffers before they leave. We've seen them do that again and again. There aren't likely any Republican readers of TPM, but if there are I'd like to address them: FWIW, I HATE YOUR PARTY WITH ALL MY HEART AND SOUL and wish that with a few exceptions, the lot of them would voluntarily hand themselves over to life-terms in their own concentration camps. They truly, truly deserve such a karmic lesson. Maybe next lifetime they will be decent individuals.

One can hope.

That three-judge DC Appeals panel was an unfortunate turn of the draw, as only three of the sixteen judges are tRump appointees, and two got the call to rule on the Boasberg case(s). Rao and Katsas are rather hard-liners, largely standing up for tRump when en banc hearings are requested. Most if not all of the other jurists, whose appointments ranged from George HW Bush to Biden have come down hard on tRump cases, and as luck would have it, the immigrant deportation rulings by the district court got that door slammed shut by the tRumpy judges.

Roberts is the worst

Chief Justice SCOTUS

has had in my lifetime.

The shadow docket is a

black mark on this court.

Southern states are

notorious for their lack

of good education in the

public school sector.

Most red states are.

Private school vouchers

are the big deal down

here. Look at the 7

billion being withheld for

after school care etc.

Where and who is this m

money going to? The elites?

This shadow docket ruling on the RIF is a prime example of judicial cynicism. Perhaps it's the worst I've seen since I became a court watcher back in the Gideon v. Wainwright days. I'm not indulging in hyperbole in thinking that this may be the most cynical, despicable and partisan Court in American history and Chief Justice Roberts the worst Chief Justice. To cripple the DOE so that it cannot carry out its congressionally mandated duties while claiming it's merely upholding the executive's right to shrink departments to his liking is a prime example of turning a blind eye to real-world consequences and grounds for making reasonable people give up on this Court.
