Spoiler Alert: Surprise! There is no federal “mortgage fraud” statute.

Definition of fraud has four elements each of which must be separately proved:

(1) Purposely telling a falsehood to a “person”.

(2) For the purpose of having that “person” acting on that falsehood to their financial detriment.

(3) That the “person” then did act on that falsehood.

(4) And that “person” was actually financially injured.

In most federal statutes, the term “person” is defined to include a corporation.

Presumably the falsehood was trying to get a lower mortgage interest rate on the second house purchase. Did the bank not know about the first house and mortgage? Not bloody likely. Was the second “primary residence” item filled in without the bank’s knowledge?

Get serious.

Are there millions of Americans with second residences — vacation homes — who have done the same thing collaborating with the bank. You bet your bippy.

You all know that what’s happening to Cook is maybe outweighed than it being a flag that Trump will be pushing a lot of resignations of people on the FOMC so he can get a majority of puppets who’ll give him (and the poorer MAGAts) the lower interest rates the former wants and the latter need..

Bill Pulte seems a very unlikeable fellow despite his millions of followers. The latter fact says something about how many folks out there follow individuals like him. These are dark times. It could be there are wrongdoings involved and if so the responsible folks should be brought to account even if they're Democrats. Party affiliation doesn't matter; we're not a cult. Witch hunts and open-ended inquiries do matter, and in the last seven months we've seen all too many of them.
