Thank you David for a

good MM and your

closing on Katrina.

It only took 1 month for

the state I live in to

move into drought

warnings, after a very

wet spring and early

summer. Some areas,

more heavily populated

populated and much

closer to these AI super

power draining centers,

were in extreme drought.

We finally had rain and

have cooled way down,

and the forest I live in is

perking up. Forecast

says this will be the

possible coolest record

September here. I see

climate change up close and personal here.

Thankful my state, right

now, isn't on the "No

Covid" booster list, so

will be getting mine very

soon. Be smart. Get the

shot!

I had not previously read Cheryl Wagner’s recounting of the Katrina rebuild. It’s as timely now, twenty years later, as it was ten years ago.

Rat-fuck, Jr has a new slogan: Make America Sick Again, as his anti-vax campaign had dropped childhood vaccinations significantly, and now he's drastically restricting the Covid vaccine's availability to Over-65, or if presenting a doctor's certification of "pre-existing" medical condition allowing for Covid vaccination for all Americans between 18-65 yoa.

Oh, just spiffy...jfc.

I'd say Susan Collins could go fuck herself, but, I'm sure she'd just be "concerned" but not "alarmed."

We're already PAST the climate tipping point and Trump and his ghouls are champing at the bit to supercharge it. And Russia, and India, and China, and all of the wars. We're done. We just haven't laid down yet.

20 years since Katrina, but, thankfully, FEMA has been shuttered. Oh, wait...

As they used to say in the pool hall I frequented , "stick a fork in him- he's done.'

Pretty harsh specially when its a whole country were talking about.

How were the 16 "pre-approval" jurisdictions selected? My state is among them.

However, it will be interesting to see if insurers DO cover the COVID vaccine since my guess is that it will be much less expensive than potential hospitalization.

Those states have laws that prohibit pharmacists from administering vaccines that are not recommended by the Advisory Committee on Immunization Practices, a Centers for Disease Control and Prevention panel, which doesn't meet until next month.

In an update to the NYT story I cited, CVS said it is now administering the COVID vaccine in 13 of the 16 states if you have a prescription from a doctor, which is still a big change in how vaccines are dispensed. MS, NV, and NM are the three where CVS is still holding back.

Really good point. And Public Health is much less costly than the alternatives for us all.

“Then COVID hit, and I still haven’t been able to reconstitute the mental file drawer of life and world events.” I think this is true of all us, all over the world. Covid PTSD may be the fundamental explanation for the various shitshows that are going down in the so-called liberal democracies, and some other more authoritarian polities. We were collectively exposed to fear in a way that we hadn’t been for generations, and that opened neural pathways that are very difficult to close. IMO, that’s why Trump (and Farage, and LePen, and the aFT etc) have successfully exploited: a wild upswing in nameless dread.

To clarify a point that David handled in a somewhat slippery way making it sound *procedurally* unusual:

Circuit Courts of Appeals hear the initial appeal with a three judge panel. Losers can then ask under a number of circumstances to have the appeal reheard “en banc”, that is, by a panel composed of all of the circuit’s judges.

The purpose or goal of requesting an appeal is”en banc” rehearing is exactly to have the initial decision flipped.

So, again, what David reported re the DCCA decision is *procedurally* very normal.

Of course what the Roberts junta does, if the case reaches it, will likely be anything but normal…

David Kurtz's avatar

Not normal for the appeals court to DENY en banc review conditioned on the three-judge panel reissuing its opinion after it eliminates a key substantive element of its ruling. There's actually even more going on than that in terms of timing and ready availability of relief to the plaintiffs, what Lederman called "shrewd." But this is not the sequence we see in most en banc review requests.

David, thanks for the clarification.

This is the case where the three judge panel reversed themselves or something before it reached the en banc stage?

Expand full comment
David Kurtz's avatar

Or something ;)

Some observers see signs of quite a bit of internal appeals court wrangling to sort this out. Lederman, again: "Not difficult to imagine this was the result of a great deal of thoughtful internal collaboration and comity, under acute time pressure."

I live in Oregon and am over 75, will I. eligible for the vaccine?

If I can't get the vaccination then subsequently die from Covid or it's complications, then please giftwrap my decaying corpse and FedEx it to the Secretary

JOIN THE DEMOCRACY TRAIN.

The AFL CIO protest has a slight slant towards worker's rights, while the MayDay protest leans more into civilian rights. Each speaks out against the Trump Regime.

Both have marches and rallies, while the AFL CIO is also hosting picnics and parades. They each share some of the same local events. Why not attend both?

🍃"Clearly, Lutnick is betting on the IEEPA tariffs being struck down. Cantor will collect 100% of the refund plus interest."

🍃"When Trump’s [Tariff] case is ultimately ruled illegal in October, it will retroactively invalidate the tariffs already collected. That triggers a refund crisis."
