However, it will be interesting to see if insurers DO cover the COVID vaccine since my guess is that it will be much less expensive than potential hospitalization.
Those states have laws that prohibit pharmacists from administering vaccines that are not recommended by the Advisory Committee on Immunization Practices, a Centers for Disease Control and Prevention panel, which doesn't meet until next month.
In an update to the NYT story I cited, CVS said it is now administering the COVID vaccine in 13 of the 16 states if you have a prescription from a doctor, which is still a big change in how vaccines are dispensed. MS, NV, and NM are the three where CVS is still holding back.

Covid PTSD may be the fundamental explanation for the various shitshows that are going down in the so-called liberal democracies, and some other more authoritarian polities. We were collectively exposed to fear in a way that we hadn’t been for generations, and that opened neural pathways that are very difficult to close. IMO, that’s why Trump (and Farage, and LePen, and the aFT etc) have successfully exploited: a wild upswing in nameless dread.
To clarify a point that David handled in a somewhat slippery way making it sound *procedurally* unusual:
Circuit Courts of Appeals hear the initial appeal with a three judge panel. Losers can then ask under a number of circumstances to have the appeal reheard “en banc”, that is, by a panel composed of all of the circuit’s judges.
The purpose or goal of requesting an appeal is”en banc” rehearing is exactly to have the initial decision flipped.
So, again, what David reported re the DCCA decision is *procedurally* very normal.
Of course what the Roberts junta does, if the case reaches it, will likely be anything but normal…
Not normal for the appeals court to DENY en banc review conditioned on the three-judge panel reissuing its opinion after it eliminates a key substantive element of its ruling. There's actually even more going on than that in terms of timing and ready availability of relief to the plaintiffs, what Lederman called "shrewd." But this is not the sequence we see in most en banc review requests.
Some observers see signs of quite a bit of internal appeals court wrangling to sort this out. Lederman, again: "Not difficult to imagine this was the result of a great deal of thoughtful internal collaboration and comity, under acute time pressure."
