So, this is the part of Article II that Blanche is claiming gives the President sole authority to appoint "...Officers of the United States...". Contrary to Blanch's sneering assertion, the Constitution grants no authority to anybody to appoint "Interim XXX" officers. Constitutionally, there is no such thing as an interim officer. Since the President's powers are enumerated and limited, Trump cannot Constitutionally appoint any interim officers. Pursuant to the first paragraph above, Congress alone decides who gets to appoint inferior officers. Congress passed laws dealing with extended vacancies in official positions, specifying that the President can appoint an interim attorney - which qualifies as an inferior officer - but that after that 120 day expiration limit passes, district judges can fill US Attorney positions that remain vacant. That's the law, and it's Constitutionally firm.
Along with that, there is no Constitutional provision for the existence of "Acting xxx", an unconstitutional ploy which Trump used extensively to avoid Senate hearings during his first term. All Presidentially appointed Officers whose positions were created by Congressional Act (like heads of Departments) *must* go through the Advice and Consent process.

Under Section 2, The President has the power to appoint those for whom he can get Senate approval, "but the Congress may by Law vest the Appointment of such inferior Officers, as they think proper, in the President alone, in the Courts of Law, or in the Heads of Departments." That's just what Congress did. An interim US Attorney is exactly that: an inferior officer.
Any "unitary executive" theory on this will have to directly contradict the power Congress was given directly by the Constitution WITHIN the Article enumerating the Presidential powers.
I don't see this as a challenge to the Senate's powers to Advise and Consent. It is a challenge to Congress's consitutional power to act when the president can't get past that power.
Federal judges really, REALLY need to toughen their stance against the antics of Bondi and the DOJ regarding the business of "special attorneys" or "special prosecutors" continually pre-empting judicial choices who replace "temporary" USAs unable to pass Senate muster. The only thing "special" about these bogus appointments is their astounding incompetence, which is truly the hallmark of an authoritarian regime: It is staffed principally by dumbfucks...which in turn torpedos the intended mission of top-down control.
So, judges, don't let these fools linger around for months doing nothing constructive, just wasting valuable court time on horse-shit prosecutions...just bar them from the courts immediately, full stop.
