Re the motorboats. Last I heard US law does not make drug smuggling a capital offense punishable by death. Also who actually determined who was on the boat, crew yes, but maybe wives and children too. Are we now in the business of killing them as well?
There’s picking a fight and trying to pick a war, say by bombing that country’s vessels. And what would be the advantage of that? Perhaps the excuse to ramp up deportations of those who have sought refuge and safety in the US?
Re: 5th Circuit panel decision on AEA — it's entirely likely that an en banc hearing would overturn the district court, and even more likely that Scotus would support their pet "unitary executive" in doing whatever he wants to do coz pres'dint. Short-term win, but don't get your hopes up.
