Complicit federal judges and the appeal process have combined to virtually destroy timely accountability for crimes committed by tRump in particular. He's had his comeuppance in state courts, but even here the ability to keep pushing his appeals to higher and higher jurisdictions, and the significant time elements embodied in the process - not to mention the enormity in legal fees that tRump is incurring across several fronts - mock the entire nature of "no man is above the law".

In truth, one wonders if all the civil and (possible? likely?) criminal sanctions imposed upon him will EVER be exacted in his lifetime...I mean, he could literally die a free man whilst all the many of his cases are still held up by various appeals or retrials. For tRump - and he alone, with all his criminal or civil transgressions, ultimately there seemingly is no justice, as remarkable as that may appear.

Personally, if his cases aren't concluded by the time he dies, I won't shed a tear. He's already 78 and appears to be going rapidly downhill. Just last weekend he expressed joy that RFK Jr., his favorite loony tune, has "joined the ticket."

Unless it’s part of a reactionary project, there’s no such thing as an airtight case as long as we have the current Republican majority at SCOTGOP. I’m read to bet right now on them affirming Cannon.

It's a "Colossal Systemic Failure" that almost half of the electorate keeps allowing themselves to be duped into voting against their own best interests, over and over, election after election.

Contrary to what all the lawyers here would have you believe, judges are unconstrained by law. They are free to rule in any way they wish, and sadly, no other institution with the power to do so, say Congress or the Executive, is willing to tell them to pound sand.

No, they are not. They are constrained by laws and procedures, and most judges abide by them. But for those who don't, there is the appeal process. Cannon is a lousy judge. Smith, however, never lifted a finger to get her removed from Trump's case. She sent a message to all Trump and MAGA judges- that they can abuse the system they swore to uphold and get away with it.

He didn’t need to in this filing. It’s safe to assume he’s going to win this appeal, having been overruled 3 times by the circuit appeals court they may well reassign her themselves robbing Trump of the ability to harp about Jack Smith having her removed for political reasons. If they don’t remove her of their own accord he can still ask that they reassign the case to another judge. There’s no reason for folks to get worked up about her removal not being asked for…yet.

No, he didn't. It's also extremely difficult to get a judge removed from a case, and perhaps Smith didn't think the risk was worth it. Imagine how biased she'd be in the wake of an unsuccessful motion to get her booted off the case. She'd never let Smith live it down. This is why I wish he'd done it at the beginning of the case.

I doubt that Smith could credibly move for the removal of Aileen Cannon at this late date. Why he never did so up until now is simply mystifying. It also sets a tone for how much crap Trumpy judges can pull and get away with. And by the way, as a former employee of the NY State courts, I never had any hopes of any of the Trump cases being concluded before November. The wheels turn slowly and tend to get stuck in the mud.

He didn’t have solid grounds to ask her to recuse not that he would have. The U.S. legal system sucks when it comes to removing an obviously biased judge. It shouldn’t take an appeals process. Like any job her superiors should be watching her performance and be able to step in when she’s obviously foot dragging. This will be overturned and I would hope the circuit court will reassign the case when they send it back down.

The real question is why Merrick Garland did not do his job to preserve, protect, and defend the constitution of the United States. What does someone have on Garland? Then why did FBI director Wray testify in June 2021 that there was no evidence of a coordinated conspiracy behind 1/6/2021 and testified there were only a few isolated individuals and small cells? Why has this now proven false testimony not been confronted by any media organizations. Why did the DOJ only go after Proud Boys, Oath Keepers, and individuals and not go after the bigger actors?
