The APA, Administrative Procedures Act, requires the administration not to do anything that’s ‘arbitrary and capricious.’ —I’m paraphrasing here..

It’s been the go to statute to stop outrageous admin actions, from my wheelhouse, fiddling the census process, [undercount issues], at least since the 1980s. Was the fig leaf that Roberts used in 2019 to support the plaintiffs pushing to get the citizenship question off the 2020 census form.

Now it looks like the court has flipped the script, thinking [but not saying] in the emergency filings…give them the benefit of the doubt and let the administration proceed…it it turns out when the “real” case works its way back to us, that the APA challenge was legitimate, we can rule again….

That gives the administration the running room it needs to savage the state without getting the justices hands dirty by admitting what they are up to….
