The APA, Administrative Procedures Act, requires the administration not to do anything that’s ‘arbitrary and capricious.’ —I’m paraphrasing here..
It’s been the go to statute to stop outrageous admin actions, from my wheelhouse, fiddling the census process, [undercount issues], at least since the 1980s. Was the fig leaf that Roberts used in 2019 to support the plaintiffs pushing to get the citizenship question off the 2020 census form.
Now it looks like the court has flipped the script, thinking [but not saying] in the emergency filings…give them the benefit of the doubt and let the administration proceed…it it turns out when the “real” case works its way back to us, that the APA challenge was legitimate, we can rule again….
That gives the administration the running room it needs to savage the state without getting the justices hands dirty by admitting what they are up to….

I think Miller might be someone who is directing things in a general sense in the administration. He, more than anyone else, may be emerging as a Thomas Cromwell to Trump's Henry VIII- an effectuator and hatchet man whose power is waxing as the president declines.
Any sign that Musk is dumping serious money into his political party? Near-infinite money might divert 5% of the vote, which could make a serious difference.
Toward the end of the Senate Judiciary committee hearing today, Chairman Grassley (R-out to pasture) claimed that Democrats cut off debate before Senators had an opportunity to speak about a nominee in 2023. Was that even comparable to what happened today?
Whatever happened to the Government in the Sunshine Act (1976) Enacted post Watergate, It was designed to ensure certain agencies when making policy changes be open to the public. The FTC and FCC among others are subject to the Act which has never been repealed to my knowledge. In this era of behind closed doors why hasn't the act been invoked or lawsuits been brought? Has everyone forgotten it?
My question is about whether Democrats taking over Congress in 2026 is really the best hope. Yes they could block things, but they couldn't repeal things or get new things done because of the veto power. At this rate, most of the damage will have been done before they are seated.
Question: What can we know about the RIFs (reductions in force) in federal departments and agencies now that the Supreme Court has lifted the preliminary injunctions?
It appears U.S. District Judge Susan Illston wants to review all the RIF plans to see if they are legal, but the government insists they can provide only redacted copies. Previously, the Department of the Interior presented a 73-page document that was entirely redacted except for the first paragraph.
I predicted long ago (though it didn't require any particular acumen to do so) that this administration would go to unheard of lengths to cloak itself in secrecy, cutting off any leaks to the press, and require widespread polygraph testing on a regular basis of its own employees. They're still trying to hermetically seal things up.but I don't think it's an impossible goal possible given the size of the government workforce. The Administration is still fighting strong headwinds in the lower courts and outright fabrications quickly evaporate in court, but I think tactical obfuscation will continue to be their favorite recourse.
