Thank you TPM; I am a retired CA Trial Attorney. Evidence in the Courtroom must be going very badly indeed for Tacopina to file a motion for a mistrial under seal. Defense counsel is already desperately highlighting micro issues & working on an appeal. Testimony of tfg's prior sexual assaults & modus operandi is expressly permitted under the relevant statute. Note, two female witnesses will testify shortly.

And it certainly doesn't help that Trump refuses to attend. All his lawyers can do is try to create issues that can be the basis of an appeal.

I cannot help wondering about that letter (an ex parte communication to the presiding judge during an ongoing trial) and think it was possibly sent as a way to cause a mistrial (which it would if the judge had responded to it instead of releasing it publicly). If these concerns about judicial errors were genuine, the Trump shysters could have filed a motion instead. And I have to admit, the whole letter is laughable whining, especially their protest about how many lawyers each party has.

You are correct Marycat2021, filing a letter for a mistrial instead of the required motion with admissible evidence is absurd. The letter is a non-starter as a breach of Federal Rules of Civil Procedure (FRCP).

Complaints about evidence rulings are losers as appellate Courts give wide discretiion to trial judges who have the full knowledge of the proceedings upon which to make decisions.

Tacopino's client is steadily losing his base & is out of control.

I used to be a court clerk, and it was one of the first things I learned. The attorneys know damn well that a letter like that could destroy the whole case. Attorneys do not even try stunts like that. I actually laughed out loud when I read it, especially the whining about who has the bigger legal team. I don't understand why any lawyer would stoop to representing the conman Trump, and destroy their careers the way we've seen so many of them do.
